END USER LICENSE AGREEMENT (EULA)

Company: Infinitum Imagery LLC DBA Infinitum LIVE Creator Network



MARK: SECTION 1 – ACCEPTANCE


By downloading, accessing, or using any applications, tools, services, or platforms offered by Infinitum Imagery LLC, including but not limited to the Infinitum LIVE Creator Network, InfiniVIEW, iVIEW, and all other branded mobile, desktop, and web applications (collectively “Applications”), you (“User”) agree to be legally bound by this End User License Agreement (“Agreement”).


If you do not agree to the terms of this Agreement, do not install or use the Applications.



MARK: SECTION 2 – LICENSE GRANT


Infinitum Imagery LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Applications solely for personal or internal business use, in accordance with the terms outlined herein.


You may not:


  • Reverse engineer, disassemble, decompile, or derive source code from the Applications.
  • Copy, redistribute, reproduce, or sublicense the Applications without explicit written permission.
  • Use the Applications for unlawful purposes or to compete with Infinitum Imagery LLC.



MARK: SECTION 3 – OWNERSHIP


All content, software, logos, graphics, trademarks, algorithms, and databases contained within the Applications are intellectual property of Infinitum Imagery LLC and are protected under U.S. and international copyright, trademark, and trade secret laws.


You are granted no rights or ownership except as explicitly stated in this Agreement.



MARK: SECTION 4 – USER CONTENT & CONDUCT


Users of Infinitum LIVE Creator Network and associated Applications must abide by platform guidelines, including but not limited to:


  • Compliance with all TikTok, Apple, Google, and applicable third-party service terms.
  • No abuse, harassment, discrimination, hate speech, or illegal activity of any kind.
  • Content or data submitted remains your responsibility. You grant Infinitum Imagery LLC the non-exclusive, worldwide, royalty-free right to use, display, and store submitted content within the scope of the Applications.


Violations may result in suspension or termination of access and legal action.



MARK: SECTION 5 – DATA COLLECTION & PRIVACY


Infinitum Imagery LLC may collect data including but not limited to:


  • Usage statistics and performance metrics
  • Identifiers such as IP address, device ID, and account information
  • User-submitted forms, feedback, or media uploads


Data is used to:


  • Improve performance and personalize user experience
  • Provide customer support and analytics
  • Enforce rules and monitor abuse


Data is handled in accordance with our [Privacy Policy], which is hereby incorporated by reference.



MARK: SECTION 6 – UPDATES & MODIFICATIONS


Infinitum Imagery LLC reserves the right to:


  • Modify, suspend, or terminate features or availability without notice.
  • Update this Agreement at any time. Continued use of the Applications after changes means you accept the updated terms.


It is your responsibility to review this Agreement regularly.



MARK: SECTION 7 – TERMINATION


This license is effective until terminated. Your rights under this EULA will automatically terminate without notice if you:


  • Breach any part of the Agreement
  • Attempt to circumvent security or violate platform terms


Upon termination, you must delete all copies of the Applications and cease use immediately.



MARK: SECTION 8 – LIMITATION OF LIABILITY


IN NO EVENT SHALL INFINITUM IMAGERY LLC, ITS OFFICERS, DIRECTORS, STAFF, AGENTS, OR AFFILIATES BE LIABLE FOR:


  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, OR USE ARISING OUT OF OR RELATED TO THE APPLICATIONS


Maximum liability shall not exceed the amount you paid, if any, for the Application.



MARK: SECTION 9 – GOVERNING LAW


This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law provisions.


Any disputes arising out of this Agreement shall be resolved through arbitration or litigation in Allegheny County, PA.



MARK: SECTION 10 – ENTIRE AGREEMENT


This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Infinitum Imagery LLC regarding the Applications and supersedes all prior agreements or understandings.
